General

All our sales, deliveries and project planning are subject to these terms and conditions in their entirety, unless they have been amended or complemented by written agreements.

Quotations

Our quotations are limited in time, either in accordance with the statutory regulations or in accordance with specific information in the quotations themselves. Quotations are of a confidential basis and may only be made available for inspection to persons who actually process our quotations. We reserve the property rights and copyrights to all drafts and cost estimates. At our request, these documents must be returned to us if no corresponding orders are placed.

Prices

Prices are ex Dietlikon, excluding packaging and insurance. All prices quoted on price lists and brochures are non-binding and subject to change. Each order shall only be deemed to have been accepted once all details have been clarified and with the express confirmation of the supplier. Should changes occur in the course of order processing due to price surcharges, additional fiscal burdens, increases in customs duties or strong currency fluctuations, we reserve the right to adjust prices accordingly.

Payment

Personal data that you provide to us as part of your feedback will only be used to process your inquiries.

Retention of title

All goods sold remain our property until the purchase price has been paid in full (ZGB 715).

Delivery deadline

We will always endeavour to adhere to the delivery deadlines we have specified and carefully calculated, even if unforeseeable difficulties arise, but we cannot provide any legal guarantee for this. This applies in particular to cases of force majeure and strikes.

Deliveries

Your personal data will be processed exclusively for the purpose of contacting you. In the event that we are unable to consider your application at this time, we will store your data for possible consideration at a later date. You can object to this storage at any time.

Warranty and liability

Our guarantee extends from the day of delivery to all faults occurring within the agreed guarantee period (normally 1 year), provided these are demonstrably caused by poor material or faulty manufacture. In the case of warranty replacement, spare parts will be dispatched after the parts to be replaced have arrived.

However, our liability shall be limited, at our discretion, to replacement, repair of the defective items or compensation for the invoice value of the items not replaced. Any further warranty, in particular liability for the costs of disassembly or reassembly, as well as for any damage caused directly or indirectly by the delivered items themselves, their use or their defects, is rejected.

During this period, no replacement devices are provided. Modifications or repair work carried out without our written consent, as well as non-compliance with our operating conditions, will invalidate our warranty obligation.

No warranty is granted for software. Origon does not guarantee that the software functions meet the requirements of the buyer, nor that they can be used in all combinations chosen by the buyer. Origon acts as an intermediary of a license agreement between the manufacturer and the licensee. Only the provisions of such a license agreement apply. All software is supplied in its original packaging and without warranty. The operating systems comply with the industry standard as far as possible and legally permissible, although minor incompatibilities may arise. No guarantee is given for the functioning of existing software packages. Origon rejects any warranty and liability, especially for indirect or consequential damages, such as loss of profit etc. or claims by third parties.

The place of fulfillment of the guarantee is the domicile of Origon. Otherwise, the manufacturer’s warranty conditions apply.

Re-export

All products are subject to the export control regulations of the exporting countries as well as the Swiss import regulations. Re-export from Switzerland is only possible with the approval of the Federal Department of Economic Affairs, Import and Export Section, Berne and the export control authorities of the country of manufacture. The buyer is responsible for compliance with all import and export regulations.

Return deliveries

Returns of defective devices are exclusively at the expense and risk of the buyer and must be sent to Origon in the original packaging including manuals – exact written description of the fault – copy of invoice must be enclosed – items for which no fault is found (e.g. also operating errors on the part of the buyer) are regarded by us as a chargeable inspection expense. The return shipment will be charged with a test fee of CHF 100 plus shipping costs. – Repairs outside the warranty period will be charged at cost.

Place of jurisdiction

Any disputes shall be governed exclusively by Swiss law. The place of jurisdiction is Zurich.
